📄 General Terms and Conditions of Contract

1. Identification of the Parties

On the one hand, the mercantile company BRICO-COLOR, S.L., hereinafter StockPinturas, with registered office at C/ Els Riberers 1, 03720 Benisa (Alicante), provided with CIF number B-53604906 and registered in the Mercantile Register of Alicante, Volume 2525, Folio 78, Section 8ª, Page A-69557, I/A 1, and owner of the domain www.stockpinturas.com.

And on the other hand, the User, understood as any person who accesses the Website and contracts products through the forms provided for this purpose.

2. Purpose and Scope of Application

These General Terms and Conditions of Contract (GTC) regulate the access, navigation and acquisition of products through the Website. These conditions may be stored and printed by the User before starting the contracting process.

3. Acceptance

The User declares to have legal capacity to contract and fully and unreservedly accepts the GTC at the time of making a purchase.

4. Modification

StockPinturas may modify these conditions at any time. Modifications will not affect previously made purchases.

5. Obligations of the Parties

5.1 Obligations of StockPinturas

  • Provide services in accordance with what is established and good faith in contracting.
  • Clearly inform about the products, prices, and applicable taxes before contracting.
  • Deliver a copy of these GTC and, if applicable, of the particular conditions.
  • Issue an invoice or proof of payment.
  • Comply with current consumer protection regulations.

5.2 Obligations of the User

  • Complete forms with truthful and updated data.
  • Keep information updated while being a Website User.
  • Provide valid payment details and make payment according to the chosen option.

6. Product Availability

All orders are subject to availability. In case of lack of stock, the User will be informed and may choose a new delivery time, an alternative product, or the total or partial cancellation of the order.

7. Prices

Prices will be those published at the time of contracting. If there is an error in the price, the User will be informed to confirm or cancel the order. StockPinturas will not be obliged to supply products at erroneous prices.

8. Payment Methods

The available payment methods are:

  • Credit card
  • PayPal
  • seQura
  • Bank transfer
  • Cash on delivery

9. Order Acceptance

The initial order confirmation does not imply acceptance. The contract will be considered formalized once the "Shipping Confirmation" email has been sent.

10. Transfer of Ownership

The User acquires ownership of the products once full payment has been completed, including shipping costs.

11. Shipping Policy and Taxes

All products will be subject to the corresponding VAT. Consult our Shipping Policy for more information.

12. Delivery Conditions

Deliveries to the Peninsula within 24/48/72 working hours from order acceptance. No shipments are made to the Balearic Islands, Canary Islands, Ceuta, or Melilla.

13. Responsibility of the Parties

13.1 StockPinturas

Is not responsible for service interruptions due to external causes, nor for computer viruses. Guarantees a reasonable response, although it does not commit to specific delivery times.

13.2 User

  • Responsible for the data provided and its update.
  • Must protect their account and password, and notify any misuse.
  • In case of non-compliance, StockPinturas may restrict access or take legal action.

14. Right of Cancellation

The User can cancel the order free of charge if communicated before it is handed over to the carrier. Contact: info@stockpinturas.com or 621 207 154.

15. Right of Withdrawal

The User has 14 calendar days from receipt of the order to withdraw from the contract without needing justification. The product must be returned in perfect condition, with its original packaging and a copy of the invoice. Return and initial shipping costs are borne by the consumer.

16. Returns for Defective or Erroneous Products

Contact us within 24 hours of receiving the product at info@stockpinturas.com. We will examine the product and, if applicable, we will make the return or replacement without additional cost.

17. Guarantees and Information

Products may show small variations. The warranty does not cover damages due to misuse. In case of a defect covered by warranty, a replacement or refund will be made at no cost to the User.

18. Notifications

Notifications will be sent to the email address provided by the User. It is their responsibility to keep it updated.

19. Partial Nullity

If any clause is deemed null, it will not affect the rest of the document.

20. Validity

These GTC will be valid as long as they remain published and will be applicable from the contracting of products.

21. Jurisdiction

For the resolution of disputes, the parties submit to the Courts of Denia, waiving any other jurisdiction that may correspond to them.

22. Data Protection

In accordance with Regulation (EU) 2016/679 (GDPR) and the LOPDGDD, personal data provided during the purchase process will be processed by BRICO-COLOR, S.L. for order management. You can exercise your rights of access, rectification, erasure, and other legally recognized rights by writing to info@stockpinturas.com. Consult our Privacy Policy for more information.

23. Online Dispute Resolution (ODR) Platform

In accordance with Regulation (EU) 524/2013, you can access the European Commission's online dispute resolution platform at the following link: https://ec.europa.eu/consumers/odr.

📝 User Acceptance

The User, by checking the corresponding box in the purchase process, declares to have read and expressly accepted these General Terms and Conditions of Contract.
